Terms and Conditions of private car park located at 55A Jagiellońska Street in Warsaw

(hereinafter referred to as the Terms and Conditions)

§1

General provisions

  1. The regulations that define the rules of car park use have been prepared by Sante Sp z o.o. with its registered office in Warsaw (03-301), at ul. Jagiellońska 55A, NIP 5241006610, REGON 010827252, hereinafter referred to as the
  2. The car park operates on the basis of short-term rental of a parking space.
  3. Parking is a paid car park.
  4. Parking is an unguarded car park.
  5. The parking operates around the clock, every day of the week. The operator may decide on periodic partial or complete exclusion of the parking from use.

§2

Definitions

The phrases used in these Regulations shall mean:

  1. User – any person leaving the Vehicle in the area of the Car Park.
  2. Parking – a part of the property at 55A Jagiellońska Street in Warsaw, separated and marked by the Operator, being managed by it, consisting of many parking spaces, used for parking Vehicles.
  3. Parking Spot – a separate place in the Car Park intended for parking one Vehicle.
  4. Vehicle – a motor vehicle within the meaning of the Road Traffic Act with a maximum permissible weight of up to 3.5t, excluding agricultural tractors and vehicle combinations.

§3

Parking space rental agreement

  1. The car park is intended exclusively for Vehicles.
  2. Upon entering the Car Park, the User concludes a parking space lease agreement with the Operator under the conditions set out in these Regulations. Each User, deciding to use the Car Park, accepts the provisions of the Regulations and undertakes to comply with them.
  3. The rental agreement ends when the User leaves the Car Park.

§4

Parking fee and payments

  1. The parking is paid throughout the whole year.
  2. Each commenced hour of parking is subject to payment according to the price list displayed in front of the parking lot. However, if the user leaves the vehicle parking within the first hour and before 40 minutes have elapsed, then the parking is free of charge.
  3. Payment for renting a parking space is made at the parking lot’s machine or at the hotel Sante reception located on the ground floor of the building at 55A Jagiellońska Street in Warsaw. If for any reason, making the payment at the machine is not possible, the user should make the payment at the Sante hotel reception.
  4. The payment is made directly before the user leaves the parking lot with their vehicle. Once the payment for renting the parking space is made, the user has 10 minutes to exit the parking lot. After this time, additional fees will be charged to the user according to the price list.

§5

Rules for using the parking lot

  1. The entrance is limited by a barrier that automatically opens after scanning the number plate of the User’s vehicle. Exiting the parking lot is limited by a barrier that automatically opens after scanning the vehicle’s number plate numbers, provided that the user has paid the required fee for renting the parking space. The exit barrier will open if the vehicle leaves the parking lot within 10 minutes after paying the rental fee.
  2. Vehicles must only be parked on designated parking spaces. If two spaces are occupied, the user will be charged for two parking spaces. If a vehicle is parked in a way that prevents another vehicle from parking in the adjacent parking space, the user is obliged to pay for the number of parking spaces they have blocked with their vehicle.
  3. Parking is prohibited at entrances, exits, passages, areas marked with “NO PARKING” signs, or other unspecified areas.
  4. Bringing weapons, dangerous materials, and illegal substances onto the parking lot premises or leaving them in the vehicles is strictly prohibited.
  5. Users must respect traffic signs and follow the instructions of security personnel and staff of the parking lot operator.
  6. The following actions are prohibited on the parking lot premises:
    • Smoking and using open flames as well as consuming alcohol.
    • Storing fuels, flammable substances, and empty containers previously holding fuel.
    • Refueling vehicles.
    • Leaving vehicles with running engines.
    • Parking vehicles with leaky systems that result in the leakage of automotive fluids such as oil, fuel, etc.
    • Leaving unattended animals in vehicles.
    • Conducting any promotional or advertising activities, street trading, organizing gatherings, artistic performances, or any other events without the operator’s permission.
    • Washing and vacuuming vehicles.
    • Leaving vehicles without a disabled parking card as defined in Article 8 of the Road Traffic Act in places designated for disabled persons by users who do not possess a disabled parking card as defined in Article 8 of the Road Traffic Act.
    • Leaving valuable items and documents in vehicles.
    • Leaving devices used to start the vehicle in the vehicles.
    • Leaving vehicles unlocked.
    • Entering or exiting the parking lot through non-designated areas.

§6

Responsibility

  1. The parking lot is not guarded, so the user assumes all risks of damage or loss of the vehicle parked on the premises, as well as the loss of items left in the vehicle.
  2. The user is responsible for any damages caused on the parking lot premises, including to other users and third parties.
  3. The user is required to promptly inform a staff member at the Sante hotel reception about any damage caused or suffered on the parking lot and submit a relevant “Declaration” in writing in 2 copies before leaving the parking lot.
  4. Non-compliance with the parking regulations is subject to a disciplinary fine of 100 PLN for each violation. In the event that the user causes damages exceeding the specified amount of the disciplinary fine due to non-compliance with the regulations, the user will be liable for the damages on general terms.
  5. In case the user poses a threat or obstructs other users from using the parking lot, the Operator reserves the right to inform appropriate services for towing the vehicle at the user’s expense and risk, along with the right to impose contractual penalties specified in the regulations.
  6. As the parking management authority, the Operator may demand that each user present a document authorizing them to drive the vehicle.
  7. In case of non-compliance with the regulations, the user will be charged with all costs related to any damages incurred in relation to the Operator.

§7

Complaints

  1. Each user has the right to submit a written complaint to the Operator within 14 days from the date of the incident for which the user is filing the complaint. The complaint can be submitted via email to sante.flota@sante.pl, by postal mail to the Operator’s address, or directly at the Sante hotel reception.
  2. To process the complaint, it is necessary for the user to provide their personal data along with contact information and the vehicle’s registration number.
  3. The complaint does not exempt the user from the obligation to pay the fee for renting the parking space.
  4. If the complaint pertains to a fee, and the complaint is upheld, resulting in the Operator canceling the fee, the refunded amount will be transferred to the user’s bank account provided by them within 7 days from the day the user provides their account number.
  5. Complaints are processed within a period not exceeding 14 calendar days from the date of receiving the complaint.

§8

Personal data protection

  1. According to Article 13 of the General Data Protection Regulation (GDPR) dated April 27, 2016, we inform you that:
    • Administrator of the User’s personal data is Sante sp. z o.o. with its registered office in Warsaw (03-301), ul. Jagiellońska 55A
    • Administrator has appointed a Data Protection Officer, whom you can contact electronically at: iod@sante.pl
    • Personal data of the User (including Vehicle registration numbers) are processed for the following purposes:
      • In order to enter and perform a parking space rental agreement, in accordance with the Regulations, including using a parking system scanning registration numbers (Article 6 (1) (b) of the GDPR);
      • As well as in order to implement the legitimate interests of the Administrator (Article 6 (1) (f) of the GDPR), i.e.: determination, investigation and defense of claims, in particular related to compliance with the parking regulations; ensuring the safety of car park users, accompanying passengers and other persons in the car park by means of security and video monitoring.
  2. The User’s personal data may also be made available to authorized public authorities at their request. In this case, the legal basis for processing will be a legal obligation incumbent on the Administrator (Article 6(1)(c) of the GDPR) or a legitimate interest (Article 6(1)(f) of the GDPR) – depending on the nature of the request.
  3. The recipients of the User’s personal data may be:
    • Subcontractors and suppliers of the Administrator.
    • Companies providing services or IT solutions.
    • Security companies.
    • Companies providing legal or consulting services.
    • Companies archiving and destroying documents.
    • Companies providing courier and postal services.
    • Banks, insurance companies and other financial and payment institutions.
    • Local government administration bodies collecting the tourist tax.
    • Intermediary entities in hotel reservations.
    • Public authorities receiving data in connection with the implementation of legal obligations of the administrator.
  4. The User’s personal data will not be transferred outside the European Economic Area (hereinafter: EEA).
  5. The User’s data will be stored:
    • In the case of implementation of legal obligations related to accounting and taxes – for periods specified in the relevant provisions of law.
    • As part of the implementation of the parking space rental agreement – for the duration of the contract, and then for the period of limitation of claims arising from the contract or from damage resulting from the use of the car park.
    • In the case of video monitoring – until the memory of the recording equipment is full, no longer than 3 months. If it is necessary to establish, assert or defend claims – until their final conclusion, and in the case of enforcement proceedings until the final satisfaction of the claims pursued
    • In the case of a parking system and the performance of a rental contract, parking spaces – to fill the memory of the recording equipment, no longer than 30 days from the date of registration of entry and exit. If it is necessary to establish, assert or defend claims – the final conclusion of proceedings, and in the case of enforcement proceedings until the final satisfaction of the claims pursued.
  6. In cases provided for by law, the User has the right to:
    • The right to access their personal data and receive a copy thereof,
    • The right to rectify (correct) their personal data,
    • The right to erase their personal data,
    • The right to restrict data processing,
    • The right to transfer data – if the legal basis for their processing is consent (Article 6(1)(a) or Article 9(2)(a) of the GDPR) or a contract (Article 6(1)(b) of the GDPR),
    • The right to object to the processing of your personal data – if the legal basis for their processing is a legitimate interest (Article 6 (1) (f) of the GDPR).
  7. If the User considers that the processing of their personal data violates the provisions of the GDPR, they have the right to lodge a complaint to the President of the Office for Personal Data Protection, Stawki 2, 00-193 Warsaw.
  8. Providing data by the User in the form of registration number, time of entry and exit is a condition for using the car park. If the User does not agree to the terms of use of the car park, can leave the car park free of charge within 30 minutes counted from the entrance to the car park.
  9. The parking system scanning license plates works automatically, without human intervention. In cease of non-payment, the exit gate will not rise. If the gate does not rise despite paying for the parking lot, there is always possibility to ask Sante sp. z o.o. employees for intervention.
