Parking Regulations for the Private Parking Located at Jagiellońska Street 55A, Warsaw
(hereinafter referred to as the Regulations)
§1
General Provisions
- These Regulations define the terms of use for the parking lot managed by SANTE sp. z o.o., headquartered at Jagiellońska 55A, Warsaw, NIP 5241006610, REGON 010827252, hereinafter referred to as the Operator.
- The parking lot operates under short-term parking space rental terms.
- The parking lot is a paid facility.
- The parking lot is not monitored.
- The parking lot operates 24/7, all days of the week. The Operator reserves the right to periodically partially or fully close the Parking for maintenance or other reasons.
- All Users are required to familiarize themselves with these Regulations before entering the Parking area.
§2
Definitions
For the purposes of these Regulations, the following terms shall mean:
- User – any person leaving a Vehicle in the Parking area;
- Parking – a designated and marked area managed by the Operator at Jagiellońska Street 55A in Warsaw, consisting of several parking spaces for parking Vehicles, divided into zones marked as Parking A and Parking B;
- Parking Space – a designated space within the Parking intended for parking one Vehicle;
- Vehicle – a motor vehicle as defined in the Road Traffic Act with a total weight of up to 3.5 tons, excluding agricultural tractors and vehicle combinations.
§3
Parking Space Rental Agreement
- The Parking is intended for Vehicles only.
- The rental agreement is concluded when the User enters Parking A, that is, upon the registration of the Vehicle’s entry into the Parking, as recorded by the Operator’s monitoring system, or upon parking the Vehicle in a designated space in Parking B.
- The rental agreement ends upon the User’s exit from the Parking.
- Proof of the rental agreement is the license plate number recorded by the Operator’s camera upon entry into Parking A or a parking ticket obtained and placed visibly on the dashboard for Parking B.
§4
Fees
- The Parking is paid every day of the year.
- Each started hour of parking is chargeable according to the rate displayed at the entrance to the Parking. However, if the User exits Parking A within 40 minutes during the first hour of parking, this period is free of charge.
- Payment for Parking Space rental is made at the machine located on the Parking premises or at the Sante hotel reception located on the ground floor of the building at Jagiellońska 55A. If payment at the machine is unavailable, the User must pay at the hotel reception.
- Payment for a Parking Space in Parking A must be made directly before exiting the Parking. After paying, the User has 10 minutes to leave Parking A. If they exceed this time, additional fees will apply per the rate.
- Payment for Parking Space rental in Parking B must be made in advance by obtaining a time ticket from the automatic cashier located within Parking A. The ticket must be visibly placed on the car dashboard. Failure to display the ticket incurs an additional fee of PLN 150.
- Damage to a parking block within Parking B incurs an additional fee of PLN 1,000.
§5
Parking Rules
- Access to Parking A is restricted by a barrier, which opens automatically upon scanning the Vehicle’s license plate by the Operator’s monitoring system. Exit is also restricted by a barrier that opens automatically after the User has paid for Parking Space rental, provided exit occurs within 10 minutes of payment. Access to Parking B is permitted only in spaces with an unlocked parking block.
- Vehicles may only be parked in designated Parking Spaces. If occupying two spaces, the User will be charged for two spaces. Parking in a manner that prevents another Vehicle from parking in an adjacent space obligates the User to pay for the equivalent number of obstructed spaces.
- Parking in entrances, exits, driveways, areas marked “NO PARKING,” or other unmarked areas is prohibited.
- Carrying or leaving weapons, hazardous materials, or illegal substances in the Vehicle within the Parking is prohibited.
- Users must follow all traffic signs and adhere to directions from security staff and Operator personnel.
- Prohibited activities on the Parking premises include:
- smoking, open flames, and alcohol consumption;
- storing fuels, flammable substances, or empty fuel containers;
- refueling Vehicles;
- leaving Vehicles with engines running;
- parking Vehicles with leaking systems;
- leaving animals unattended;
- conducting promotional or advertising activities, street trading, gatherings, or artistic performances without the Operator’s consent;
- washing or vacuuming Vehicles;
- parking without a parking card in spaces designated for disabled persons, per the Road Traffic Act;
- leaving valuable items or documents in Vehicles;
- leaving Vehicle ignition devices in the Vehicle;
- leaving Vehicles unlocked;
- entering or exiting the Parking through undesignated areas.
§6
Liability
- The Parking is not monitored; hence, the User bears all risks of damage or loss of the Vehicle or items left in the Vehicle.
- The User is liable for any damage caused on the Parking premises, including damage to other Users and third parties.
- Users must immediately inform the Sante hotel reception staff of any damage caused or suffered in the Parking and submit a written “Statement” in two copies before leaving the Parking.
- Failure to comply with the Parking Regulations will result in an administrative penalty of PLN 100 for each violation. If the User causes damage exceeding the penalty amount due to non-compliance with the Regulations, the User is liable for the full amount of the damage under general principles.
- If the User poses a threat or hinders other Users, the Operator reserves the right to inform relevant authorities to tow the Vehicle at the User’s expense and impose penalties as specified in the Regulations.
- The Operator may request every User to present a valid driver’s license.
- Failure to comply with these Regulations will result in the User bearing full costs for any damage caused.
§7
Complaints
- Each User has the right to submit a written complaint to the Operator within 14 days of the incident via email at sante.flota@sante.pl, by post to the Operator’s address, or directly at the Sante hotel reception.
- For complaint processing, the User must provide their personal data, contact information, and Vehicle license plate number.
- Filing a complaint does not suspend the obligation to pay for Parking Space rental.
- If a complaint regarding a fee is accepted, and the Operator cancels the fee, the amount will be refunded to the User’s bank account within 7 days of providing the account number.
- Complaints will be processed within a maximum of 14 calendar days from the date the complaint is received.
§8
Personal Data Protection
- In accordance with Article 13 of the General Data Protection Regulation (GDPR) of April 27, 2016, we inform that:
- The data controller is Sante sp. z o.o., with its registered office in Warsaw (03-301) at Jagiellońska Street 55A.
- The Controller has appointed a Data Protection Officer, who can be contacted by email at iod@sante.pl.
- The personal data of the User (including vehicle license plate numbers) is processed for the following purposes:
- to conclude and execute the parking space rental agreement, in accordance with the Regulations, including using the parking system that scans license plates (Article 6(1)(b) GDPR);
- and for the purpose of pursuing the Controller’s legitimate interests (Article 6(1)(f) GDPR), namely establishing, pursuing, and defending claims, particularly those related to compliance with the parking regulations, as well as ensuring the safety of parking users, their passengers, and other individuals present in the parking area through security measures and video monitoring.
- The User’s personal data may also be disclosed to authorized public authorities upon their request. In such cases, the legal basis for processing will be the legal obligation incumbent on the Controller (Article 6(1)(c) GDPR) or the legitimate interest of the Controller (Article 6(1)(f) GDPR), depending on the nature of the request.
- Recipients of the User’s personal data may include:
- Subcontractors and suppliers of the Controller;
- Companies providing IT services or solutions;
- Security service providers;
- Legal or consulting service providers;
- Companies that archive or destroy documents;
- Courier and postal service providers;
- Banks, insurance companies, and other financial or payment institutions;
- Municipal authorities collecting local fees;
- Entities that facilitate hotel reservations;
- Public authorities receiving data in connection with the Controller’s legal obligations.
- As a rule, the User’s personal data will not be transferred outside the European Economic Area (EEA).
- The User’s data will be stored for the following periods:
- For the fulfillment of accounting and tax obligations – for periods specified by relevant laws.
- For the duration of the parking space rental agreement and subsequently for the limitation period of claims arising from the agreement or any damages resulting from the use of the parking facility.
- For video surveillance recordings – until the memory of the recording device is full, but no longer than 3 months. If necessary for the establishment, pursuit, or defense of claims, data will be retained until the claims are definitively resolved, and for enforcement proceedings until the claims are fully satisfied.
- For the parking system and implementation of the parking space rental agreement – until the memory of the recording device is full, but no longer than 30 days from the date of entry and exit registration. If necessary for the establishment, pursuit, or defense of claims, data will be retained until the claims are definitively resolved, and for enforcement proceedings until the claims are fully satisfied.
- In cases provided by law, the User has the right to:
- Access their data and receive a copy of it,
- Rectify (correct) their data,
- Delete their personal data,
- Restrict the processing of their data,
- Transfer their data – if the legal basis for processing is consent (Article 6(1)(a) or Article 9(2)(a) GDPR) or a contract (Article 6(1)(b) GDPR), f) Object to the processing of their personal data – if the legal basis for processing is the Controller’s legitimate interest (Article 6(1)(f) GDPR).
- If the User believes that their personal data is being processed in violation of GDPR, they have the right to file a complaint with the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
- Providing data in the form of a license plate number, entry time, and exit time is a condition for using the parking facility. If the User does not agree to the terms, they may exit the parking lot within 30 minutes of entry without incurring any charges.
- The license plate scanning system operates automatically, without human intervention. In case of unpaid parking, the exit barrier will not lift. The User may request assistance from Sante sp. z o.o. staff at any time, for example, if the barrier does not lift despite payment being made.
